​ACER is composed both of permanent staff and experts seconded by national regulatory authorities (NRAs) in the field of energy. The Agency's regulatory activities are overseen by a Board of Regulators, composed of senior representatives of the national regulatory authorities for energy of the 27 Member States.

Its administrative and budgetary activities fall under the supervision of an Administrative Board, whose members are appointed by European institutions.

Finally, the ACER Board of Appeal is part of the Agency but independent from its administrative and regulatory structures, and deals with complaints lodged against ACER decisions.
